LEGAL FRAMEWORK
Supreme Decree 11614 of 2nd July 1974, declaring North and South Lípez Provinces in the Department of Potosí, including much of the Salar de Uyuni, a state-owned reserve. Full text (in Spanish)

Law 719 of 15th February 1985, which sets up CIRESU with the aim of exploring, mining, industrializing and selling the evaporite deposits in the Salar de Uyuni basin; CIRESU is majority owned by the state, and the regions and different social groups are widely represented on its Board. Supreme Decree 21260 of 16th May 1986, declaring the “Gran Salar de Uyuni” a state-owned reserve with a precise perimeter including the Salar de Uyuni basin (salt crust and a wide buffer zone). Full text (in Spanish)

• Law Nº 1854 of 8th April 1998 (“the Valda Law”), which reduces the Salar de Uyuni State Reserve to an area limited to the salt crust; this is a considerable decrease in the size of the initial state reserve established by the 1986 decree. Full text (in Spanish)>

Supreme Decree Nº 26574 of 3rd April 2002, which confirms that the “salt crust” perimeter is the one set out on a map drawn up by SERGEOMIN and adopted by SETMIN, in view of the fact that Law 1854 had not precisely defined the term “salt crust” and thus its application could be disputed. Law Nº 2564 of 9th December 2003, which repeals both Law Nº 1854 and Supreme Decree Nº 26574 and declares the Salar de Uyuni a state-owned reserve, returning to the initial perimeter defined in SD 21260 of 1986, except for the area of ore deposits near San Cristóbal. Full text (in Spanish)

Supreme Decree Nº 27326 of 27th January 2004, which regulates Law 2564, identifying the state institutions that will carry out audits, setting time frames and defining the scope of review and oversight tasks. Full text (in Spanish)

Supreme Decree 27548 of 3rd June 2004, which regulates the relationship between the Bolivian state and the company Sociedad Colectiva Minera Río Grande SC (SOCOMIRG). This decree recognizes the validity of the contracts signed between this company and the Bolivian state, and instructs CIRESU (Complejo Industrial de Recursos Evaporíticos del Salar de Uyuni) to sign contracts with the company. Supreme Decree Nº 27589 of 23rd June 2004, which revokes the resolutions setting up 11 mining concessions awarded to the company Non Metallic Minerals S.A. Full text (in Spanish)

Supreme Decree 27799 of 20th October 2004, which repeals the previous SD and sets up a progressive ICM (mining tax) tariff system to promote the export of boron minerals with value added. Full text (in Spanish)

Supreme Decree 28527 of 16th December 2005, which repeals SD 25789 of 23rd June 2004 on the grounds that the administrative resolutions issued by the Mines Superintendency annulled the 11 disputed mining concessions. Full text (in Spanish)

Law Nº 3351 of 21th February 2006 on the organization of the executive branch of government (“LOPE”), which allocates stewardship over the use of evaporite deposits in the Salar de Uyuni to the Minister of Mining. Full text (in Spanish)

Supreme Decree 29117 of 1st May 2007, which declares the whole of the nation’s territory a state reserve, while respecting previously established mining concessions. This is complemented and regulated by Supreme Decree 29164 of 13th June 2007. Full text (in Spanish)

Law 3720 of 31st July 2007, which restores to COMIBOL its exploration, mining, industrialization and sales roles, as well as awarding it the power to manage state mining reserves. Full text (in Spanish)

Supreme Decree 29165 of 9th January 2008, which provides for the gradual lifting of the state reserve on Bolivian territory and the signing of contracts to lease mining areas. This is complemented and regulated by Ministerial Resolutions Nº 14/2008 of 22nd February 2008 and 79/2008 issued by the Ministry of Mining and Metallurgy. Full text (in Spanish)

Supreme Decree 29496 of 1st April 2008, which declares that mining the evaporite deposits in the Salar de Uyuni is a national priority, instructs COMIBOL to set up an operational division to take charge of exploration, mining, industrialization and sales, and allocates a budget of US$5,700,000 for the implementation of a pilot project. A draft law introduced on 5th February 2008, which seeks to declare exploration and mining in the Salar de Coipasa a priority for both the nation and the Department of Oruro, and to allocate funds for industrialization. Full text (in Spanish)
